Creating Keepsakes Issues New 2008 Hall of Fame Rules

Creating Keepsakes, as promised, issued revised rules today for the 2008 Hall of Fame contest that take into account the problems that have arisen with the 2007 contest.

The most detailed changes were in part four, which specifies the work must be solely that of the entrant:

4. The entrant must be the author of all layouts submitted, except as otherwise provided. Layouts must also be original to the author and exclusive of any material created by a third party or otherwise aided by a third party. However, photographs taken by someone other than the entrant may be used on Assignments A, C and D and all assignments in Group 2 and Group 3 if clearly marked with the following statement next to the layout: “Photos not taken by entrant.” Stock photos must also be accompanied with a credit to the photo source. The entrant must be the author of the photographs submitted in Assignment B. The photographs submitted in Assignment B also must be original to the entrant. All photo editing must be work that is original to the entrant. For photographs submitted in Assignment B, Creating Keepsakes will consider photographs as authored by and original to the entrant, even if someone other than entrant pressed the shutter release, if and only if the entrant has exhibited creative control over all other aspects of the photograph, including, but not limited to, the composition, lighting, angle, camera controls and settings, etc. Creating Keepsakes has sole
discretion to interpret whether an entrant exhibited creative control.

The rules changes also address other issues brought up by the 2007 controversy:

(iv) Creating Keepsakes is not responsible for lost, incomplete, illegible, late, or misdirected entries, inaccurate entry information, hardware, software, or other technical malfunctions of any kind. Creating Keepsakes reserves the right, in its sole discretion, to void any and all entries of an entrant who Creating Keepsakes believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Contest or to adjust the dates herein or cancel the Contest or if a computer virus or other cause beyond Creating Keepsakes’ control corrupts the administration, proper play or security of this Contest. Creating Keepsakes reserves the right, in its sole discretion, to change these Official Rules.

Also, it was changed to add this stipulation in rule 14:

Entries that include more or less than ten (10) scrapbook layouts, that do not follow the prescribed assignments, or that do not follow the Official Rules will automatically be disqualified from the 2008 Hall of Fame Contest, although the layouts may be eligible for use by Creating Keepsakes in its publications. Disqualified entrants will be required to return the $1,500 cash prize to Sponsor and give up all rights to the title of Hall of Fame. In the event that a winning entrant is disqualified after the announcement of winners is made, his or her place in the Hall of Fame will not be filled.

It is obvious from these wholesale revisions to the rules that CK has realized that their previous rules were insufficient and they have had legal help in tightening and clarifying them for the 2008 contest. Hopefully this will prevent a repeat of the 2007 problems by providing clear guidelines for both entrants and the magazine regarding the substance of the rules and their enforcement.
